Human Rights Policy Statement

KMG has adopted a Human Rights Policy by which we support internationally recognized standards for human rights and the avoidance of human rights abuses. In accordance with our Human Rights Policy, KMG confirms that our suppliers of raw materials provide a declaration on their use of conflict minerals. For 2014, all of our Tier 1 suppliers have returned either the questionnaire or a company declaration confirming they do not source conflict minerals in the raw materials supplied to KMG.

Purpose
KMG’s approach to human rights has been designed in alignment with the United Nations Global Compact and other human rights groups, leading companies, and other organizations worldwide. The purpose of this policy is to define our Human Rights Principles. Through adherence to this policy and our Employee Code of Conduct, we strive to prevent human rights abuses in our operations and businesses.

General Principles
KMG Chemicals is committed to consistently treating employees with respect, fairness, and dignity.

Employees in all regions and locations shall conduct business consistent with the principles outlined in this policy and our Employee Code of Conduct. In so doing, they agree to preserve KMG’s commitment to ethical business and integrity at all times.

We respect local sovereignty and operate according to local legal requirements including local human rights legislation and collective bargaining agreements.

Employee Relations
KMG Chemicals provides employees the opportunity to work without fear of intimidation, reprisal or harassment. It is the responsibility of managers and leaders, assisted by Human Resources, to maintain positive employee relations. The company abides by an open door policy and provides mechanisms for employees to have their questions and concerns resolved in a fair and timely manner.

Freedom of Engagement
Some of our employees are represented by officially designated third parties or designated/elected employee representatives. KMG respects employees’ voluntary freedom of association and right to bargain collectively and complies with pertinent locals laws where we operate.

Forced Labor
KMG is opposed to slavery, human trafficking and the use of forced labor of any kind.

Child Labor
KMG does not support the use of child labor and does not hire children under the legal age for employment in any location where we operate. Further, we abide by a minimum age of 18 years for hazardous work regardless of local regulations.

We encourage the creation of training, apprenticeship or intern programs tied to education.

Conflict Minerals
KMG is committed to sourcing materials from companies that share our values around human rights, ethics and environmental responsibility.

KMG Chemicals supports, encourages and values a diverse, multi-cultural workforce and fosters an environment that is supportive and appreciative of differences.

KMG considers harassment, discrimination and retaliation to be unjust and damaging to our work environment, and we maintain strong policy against such behavior. Our Harassment in the Workplace policy defines our commitment to a respectful work environment free of any manner of harassment, including but not limited to harassment based on race, color, religion, national origin, age, citizenship, gender, marital status, pregnancy, sexual orientation, gender identity and expression, veteran status, or physical or mental disability. Consequences for violating the policy are also defined.

Compensation and Working Time
We provide compensation and benefits that are competitive. Our compensation and benefits comply with applicable laws. KMG has established competitive pay levels that are based on job descriptions and independent of gender, age, ethnicity, or other personal characteristics or beliefs. Our compensation philosophy is communicated and available to employees.

We are committed to complying with local legal requirements and collective bargaining agreements regarding working time and appropriate compensation.

Environmental Health, Safety and Security
At KMG, we recognize the importance of understanding how our operations interact with the surrounding communities and environment.  In this respect, a critical element in our long-term success is a sound business infrastructure based upon:

  • Consistent and ongoing regulatory compliance
  • Identification and control of potential risks
  • Implementation of Sustainable practices

By implementing certified Environmental, Health, Safety and Security Management Systems at all our locations, KMG will continue to operate in compliance with regulatory requirements, while fully protecting the environment and the health and safety of our employees and their communities.

Anti-corruption
KMG Chemicals specifically prohibits offering, promising, making, requesting, or accepting or agreeing to accept any payments or favors that might be considered improper or illegal. Employees are expected to adhere to existing policies for global competition, anti-corruption, and ethical business conduct. Employees are trained on anti-bribery and corruptions topics and are encouraged to report any suspicions of wrong doing via the company’s hotline.

Implementation
These Human Resource Principles have been communicated and are accessible to all employees.

Employees who believe that there may have been a violation of these Principles should report it through established channels including but not limited to:

  • The manager of the department in which the violation occurred
  • Any member of KMG management
  • The employee’s HR manager
  • The Equal Employment Opportunity Officer (U.S.)
  • The Global Director of Diversity and Inclusion

No retaliatory actions will be taken against any employee who makes such a report in good faith or cooperates in an investigation of an alleged violation.

In furtherance of its commitment to Human Rights, KMG routinely requires its suppliers, vendors and contractors to certify or contractually agree to abide by all laws, rules and regulations in effect in the countries and jurisdictions in which they do business. We may also require suppliers, vendors and contractors to agree to abide by the company’s Human Rights policy, or demonstrate a commitment to Human Rights via their own policies.

Administration
KMG’s Environmental, Healthy, Safety & Security manager has overall responsibility for the administration of this policy.

Human Resources and Supervisors/Managers at all levels are responsible for upholding this policy and fully supporting the company’s efforts to create a respectful, fair, and safe work environment; to model their behavior accordingly; and to report non-compliance with this policy.

Employees are responsible for treating co-workers with respect, valuing different thinking and ideas, working effectively across differences, and reporting any violations of the principles presented herein.
